These Terms of Use govern the use of the free online service SpraySpy® SCAI ("Service"), made available by AOM-Systems GmbH, Benzstrasse 4, 64646 Heppenheim, Germany ("we", "us") at sprayspy-scai.com. By accessing or using the Service, you ("User") agree to these Terms of Use.
SpraySpy® SCAI is a free, browser-based AI tool for the analysis of spray patterns.
2.1 The Service is provided free of charge. No purchase agreement or paid service contract is entered into through the use of the Service.
2.2 We do not guarantee uninterrupted or error-free availability of the Service. We may modify, suspend, or discontinue the Service, in whole or in part, at any time and without prior notice.
3.1 The Service is intended for use by professional and industrial users with appropriate technical expertise in spray and coating processes. Users shall use the Service only for lawful purposes and in accordance with these Terms of Use.
3.2 Users shall not: (a) attempt to reverse-engineer, decompile, or extract the source code of the Service, except to the extent expressly permitted by applicable mandatory law; (b) use automated means to access the Service in a manner that places unreasonable load on our infrastructure; (c) use the Service to process or upload unlawful, infringing, or malicious content.
4.1 The Service, its outputs, and any related recommendations are provided "as is" and are intended to support — not replace — the User's own engineering judgment, quality control procedures, and compliance obligations. We do not warrant that the results generated by the Service are accurate, complete, or suitable for any particular application.
4.2 The User remains solely responsible for independently verifying the suitability of any output of the Service for its specific application, equipment, and process before implementation.
5.1 To the extent permitted by applicable law, we shall not be liable for any damages — including damage to property — arising from or in connection with the use of, or inability to use, the Service, unless such damage is caused by our intent or gross negligence, or results from the breach of a material contractual obligation (in which case liability is limited to the foreseeable, typical damage).
5.2 Nothing in these Terms of Use excludes or limits liability for death, personal injury, or health damage caused by us, or liability under applicable product liability law, or any other liability that cannot be excluded or limited under applicable mandatory law.
The Service, including its underlying software, algorithms, trademarks (including SpraySpy® and SprayAI®), and content, is the property of AOM-Systems GmbH or its licensors and is protected by copyright and other intellectual property laws. No rights are transferred to the User other than the limited right to use the Service as intended.
We may update these Terms of Use from time to time to reflect changes to the Service or applicable law. The version published on this website at the time of use shall apply.
These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). To the extent legally permissible, the exclusive venue for any disputes arising from or in connection with these Terms of Use shall be Frankfurt/Main, Germany.
